Qualmark Corporation today announced that it has filed a lawsuit in United States District Court against Data Physics Corporation for trademark infringement and unfair competition.
The case brought on by Qualmark against Data Physics is for using the Qualmark trademarks (LING and LING ELECTRONICS) without authorization. Qualmark believes that using these trademarks can cause confusion in the marketplace in connection with the advertising and sale of Data Physic’s products and services.
Speaking on behalf of Qualmark, President & CEO Andy Drenick, states, “The LING and LING ELECTRONICS brand names and trademarks are well known in the marketplace and a valuable part of our business. Although we prefer to avoid litigation, we could not stand by and allow the public to be not confused by Data Physics’ unauthorized use of Qualmark’s trademarks nor permit Qualmark’s valuable business assets to be diminished.”
If successful, Qualmark is asking the courts to place an injunction on Data Physics that will prevent their company from continuing to use its LING and LING ELECTRONICS trademarks. Qualmark is also seeking unspecified damages. The case is pending in the United States District Court for the District of Colorado.
